Homophobes Accidentally Ban Marriage in Texas
November 20th, 2009 by draconismoi

HAHAHA HAHAHAHA HAHAHAHAHAHAHA HAHAHA hahahahahah ahahahahahahahaha hahhhhahaaa s s sss ss *gasp*.

Anyone remember how Texans voted to ‘protect’ heterosexual marriages by constitutonally asserting the one man/one women schtick? And – just to be extra cautious – threw in a domestic partnership ban?

Well it seems they were a tad, dare I say, over-inclusive, with the wording?

“This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage.”

Yes. That is a line from the Texas Constitution. Making it unconstitutional for the state of Texas to so much as recognize any legal marital status.

Perhaps the formerly-married citizens of the Lonestar State would be interested to learn that they no longer automatically inherit anything upon their spouses death? Or that they will be denied hospital visitation? No joint tax returns or social security benefits. No presumption of paternity. No stepparent adoption. No guarantees of custody or child support.

Shall I go on?

You may be married per the dictates of your sacrificed god……but the state is no longer obligated to acknowledge any legal benefits of your union. Or grant you any special status merely because you choose to reside with an opposite-gender sex-partner.

But look on the bright side oh-concerned-moral-majority! You have just created sososo many jobs for lawyers in a depressed job market. There is an obvious downside of moving to Texas….unless one is willing to commute from Louisiana, New Mexico or Oklahoma. Never fear Texas, your small-government marriage-defenders are here! They will make it their mission to insure an utter lack of fascist state meddling in your religious traditions.
